もし、病院を解雇されたら？

Q:数日前にいきなり解雇されました・・・どうすれば良いですか？　　　　　　　　　　　　　　　　　　　

A：通常、普通解雇ですと１ヶ月前に言い渡します　そして１ヶ月分の賃金を支払わなければなりません　当面の生活費を渡しその間の再就職を促す為です　しかし、数日前に解雇を言い渡すのは、会社が倒産でもしない限り違法になります　また犯罪行為や故意に会社に損害を与えたりなどの、社会通念上、解雇が妥当と見なされなければ解雇は不当となります。なぜなら労働者の生活の保障がされないからです。日本の法律では労働者は守られているからです。経営者は当然熟知しているはずです。その上で解雇を行うのは、職権乱用となります　裁判を行えば負けます解雇を言い渡されたら、まず解雇理由証明書を必ずもらってください！！そしてその理由を詳しく聞いてください　その時の状況や会話などをしっかりメモしてください解雇をされると、履歴書に一生残るばかりか、社会保険や雇用保険の退職理由にも残ります　履歴書には書かなくとも再就職先にはバレてしまいます　ですので、解雇は撤回した方が今後の就職には不利にはならないでしょう　　　　　　

Q：解雇理由をもらった後はまず何を始めれば良いですか？　　　　

A: まず、今後の方向性を決めます大きく分けて二つになります　　　　

１)　解雇を撤回し職場復帰を目指す

２)　解雇の撤回と不当解雇による慰謝料（通常、解決金といいます）年収相当（正確には解雇され出勤停止となり、提訴し判決が確定するまでの未払いの賃金分、ボーナスは含まれず）を請求する

１) は、裁判を起こし判決により元の職場に戻ります　しかし一度、雇い主と争い拗れた関係のまま職場復帰するにはかなりのリスクが伴うもの　イバラの道となるため相当の覚悟が必要になるでしょう・・・それでも仲間がいたり、業務が好きだったりなどの理由があれば選択肢の一つになります　

２) は、不当に解雇するような所には戻りたくない、しかしそれ相応の解決金をもらい合意退職にすると言うもの現実的には２の場合が多く、実際私自身も選択しました

Q：方向性が決まったら、次は何をしますか？

A:まずは手軽な所から勤務先の管轄である労働基準監督署に相談に行くといいでしょう　しかし労働基準監督署はあくまで相談　　　をするものと捉えておくといいでしょう　解決策にはなりません給料の未払いに関しては素早く対応してくれますしかし手応えを感じなければやはり法律の専門家である弁護士に相談するのが良いですしかし弁護士に依頼するのは費用の心配や敷居が高いなどの問題が生じますそこでお勧めは国によって設立された無料で弁護士に相談出来る法テラスです無料の法律相談ですので、気負うことなくご相談されるといいでしょう　お近くの相談所を調べて行かれると良いでしょうさらに詳しくお聞きしたい方は、メールをお送りください　私の体験談を参考にしていただければ幸いです　

Q：弁護士はどうやって見つけるの？知り合いもいないし・・・お金も無いし。

A：私の場合は、１度目はたまたま友人の知人に弁護士がいて急遽お願いをすることが出来ました。その時の費用は税込みで３１万５千円でした。分割でも可能でしたが、解雇手当金が入ったので一括で支払いました・・・最初に支払うのは着手金と言う名目ですが、事務所により金額は変わります。２度目は、法テラスと言う経済的に困窮している人の為に国が設立した無料の法律相談を行ってくれるとこです。全国にあり、様々な分野の弁護士がいます。３０分の短い時間で弁護士が提訴した場合、勝てる見込みがあれば弁護を引き受けてくれます。私の場合は不当解雇でしたので即、弁護を引き受けてくれました。法テラスでの民事法律扶助を受ければ弁護士費用は安くすみます。しかし、法テラス基準の審査があり、経済的に困窮している事を証明する為、給与明細書や預貯金を提示しなければなりません。私はすぐに失業保険を貰えたので、審査は問題なく通りました。相場は一般の費用の３分の１くらいです。私の担当の弁護士は大きな事務所の労働専門の弁護士で有能だった為、弁護料上限の一番上で、１５万でした。それを分割払いにし、毎月５千円を２年以上かけ支払いました。３度目は、２度目にお世話になった弁護士さんにお願いしました。３度目と言う事もあり、苦笑いされましたが・・・その時の費用は４２万円でした。こちらは一括で支払いました。着手金以外では相手方への内容証明として５千円、訴訟提起にあたって裁判所に納める手数料３万２千円、収入印紙代６千円などです。その後は裁判が終了し解決金が貰えたら、成功報酬として解決金の平均１６％を引かれた金額が弁護士を通じて指定した銀行に振り込まれます。それを確認した時点で全て終了です。

Q:　個別労働関係紛争のあっせん、とは？

A：解雇通告を受けてから弁護士を挟んでのやり取りの中で、相手方からこの様な提案がなされる事がしばしばありました・・・あっせんとは？簡単に言えば第三者を挟んでの話し合いでの解決を目的としてしているものです。都内でしたら東京労働局で行われます　紛争調整委員会のあっせん委員１名が担当します。１回のみで終了となります。基本的に相手方と顔を合わせることはありません。解雇における補足資料などを持ち込んだりし、和解を前提としている為、あっせん委員が双方の意見を聞き客観的な意見を述べるだけで、事実の断定や判決を行うものではありません！相手方は解雇通告を言い渡すほどなので、そもそも話し合いなどで解決するつもりなどありません。正直。時間の無駄です・・・
